Terms of Service

1. Scope

These Terms of Service ("Terms") govern your use of the Whistype desktop application ("Application") and the website whistype.com ("Website"), provided by Florian Rothenbühler, c/o F2BII E-Commerce#511, Hintergoldingerstrasse 30, 8638 Goldingen, Switzerland ("Provider").

By downloading, installing, or using the Application, you agree to these Terms. If you do not agree, do not use the Application.

2. Description of Service

Whistype is a desktop dictation application for Windows that converts speech to text. The Application offers:

• Local mode: Transcription using a local speech-to-text model on your device. No internet connection required.
• Cloud mode: Transcription via third-party API providers (e.g. OpenAI Whisper, Deepgram, Groq). Requires an internet connection.
• Bring Your Own Key: Use your own API keys for cloud transcription at your own cost.

3. License

The Provider grants you a non-exclusive, non-transferable, revocable license to use the Application on your personal devices for personal or professional purposes. You may not:

• Redistribute, sublicense, or sell the Application
• Reverse-engineer, decompile, or disassemble the Application beyond what applicable law permits
• Use the Application to provide transcription services to third parties on a commercial basis

4. Pricing and Payment

The Application offers free and paid tiers:

• Free (Local): No account required. Full local functionality at no cost.
• Free (BYOK): Use your own API keys. No subscription required.
• Free Account: 500 words per week of cloud transcription, resets weekly.
• Basic: CHF 5 per month. Unlimited cloud transcription.
• Pro: CHF 12 per month. Premium models and features.

Payments are processed by Paddle.com Market Limited ("Paddle"), who acts as the Merchant of Record for all paid subscriptions. Paddle handles billing, invoicing, tax collection, and payment processing on behalf of the Provider. By purchasing a subscription, you also agree to Paddle's Terms of Service.

All prices are in Swiss Francs (CHF). Local taxes (VAT) may be added depending on your location and are calculated and collected by Paddle.

5. Subscription and Cancellation

Paid subscriptions renew automatically each month. You may cancel your subscription at any time through the Application settings or your Paddle customer portal. Upon cancellation:

• Your subscription remains active until the end of the current billing period.
• No further charges will be made after cancellation.
• The Application reverts to free-tier functionality after the subscription expires.

6. Refund Policy

You may request a full refund within 14 days of your initial purchase or any renewal, no questions asked. To request a refund, contact fr@florianrothenbuehler.com or use the Paddle customer portal.

Refunds are processed by Paddle and typically take 5–10 business days. Upon refund, your subscription is cancelled and the Application reverts to free-tier functionality.

7. Data Processing

Details on how the Application processes your data are described in our Privacy Policy. In summary:

• In local mode, audio is processed entirely on your device and never transmitted.
• In cloud mode, audio is sent to the selected transcription provider, transcribed, and discarded. Whistype does not store your audio.

8. Availability and Updates

The Provider aims to keep the Application functional and up to date but does not guarantee uninterrupted availability. Cloud transcription depends on third-party API providers whose availability is outside the Provider's control.

The Provider may release updates at any time. Major changes to functionality or pricing will be communicated in advance.

9. Limitation of Liability

The Application is provided "as is" without warranty of any kind, express or implied. To the maximum extent permitted by applicable law:

• The Provider is not liable for indirect, incidental, or consequential damages arising from the use of the Application.
• The Provider's total liability is limited to the amount you have paid for the Application in the 12 months preceding the claim.
• The Provider is not liable for the accuracy of transcriptions or any decisions made based on them.

10. Intellectual Property

The Application, its source code (as published on GitHub), documentation, and branding are the intellectual property of the Provider. The open-source availability of the code does not transfer ownership or grant rights beyond those specified in the applicable license.

11. Changes to These Terms

The Provider may update these Terms at any time. Material changes will be communicated via the Website or within the Application. Continued use after changes constitutes acceptance of the updated Terms.

12. Governing Law and Jurisdiction

These Terms are governed by Swiss law. The exclusive place of jurisdiction is Burgdorf, Canton of Bern, Switzerland.
